Era pouco antes das 11 horas (9 horas no horário dos Estados Unidos), desta quinta-feira (18/4), quando Danilo Sousa Cavalcante surgiu na tela de transmissão para prestar depoimento à Justiça do Tocantins, por videoconferência. Cumprindo pena perpétua em prisão Americana, Danilo é acusado de assassinar Válter Júnior Moreira dos Reis, em 2017, na cidade de Figueirópolis, a 270 quilômetros de Palmas.
De uniforme laranja e cabelos grandes, o réu estava aparentemente incomodado e, durante entrevista reservada com a defensora pública Cristiane Japiassu, manifestou que não queria participar da audiência de instrução. Ele abriu mão de ser ouvido, direito que lhe foi concedido pela Justiça do Tocantins.
O juiz Jossanner Nery Nogueira Luna, titular da Vara Especializada no Combate à Violência contra a Mulher e Crimes Dolosos contra a Vida de Gurupi, responsável pelo julgamento, adiou a audiência de instrução, que seria realizada em outubro de 2023, para aguardar o cumprimento da carta rogatória (instrumento jurídico para comunicação entre as justiças de países diferentes). Assim, sem a presença do réu, a sessão, que durou aproximadamente uma hora, foi realizada no Fórum da Comarca de Gurupi, com o depoimento de cinco testemunhas de acusação indicadas pelo Ministério Público. Duas testemunhas prestaram depoimento por videoconferência e três presencialmente.
“Ele tem que pagar pelo crime que cometeu aqui no Tocantins, porque está preso nos Estados Unidos pelo crime que cometeu lá”, disse Jessica Wemilly Silva Moura, amiga da vítima e uma das testemunhas presentes à audiência.
Instrução processual
A instrução processual foi encerrada e agora segue para o Ministério Público para que possa fazer as alegações finais. Depois será a vez da defesa e, na sequência, o processo volta para o Judiciário para o juiz Jossanner Nery Nogueira Luna, titular da Vara Especializada no Combate à Violência contra a Mulher e Crimes Dolosos contra a Vida de Gurupi, decidir se o réu será levado ou não a júri popular.
Também participaram da audiência o promotor de justiça Rafael Pinto Alamy (acusação) e a defensora pública Cristiane Japiassu, que representa o acusado.
Acordo internacional
Inédita no Judiciário tocantinense, a audiência foi realizada por meio de um Acordo de Cooperação Internacional entre o Poder Judiciário do Tocantins e a Justiça norte-americana, com o apoio do Ministério da Justiça brasileiro. A data da audiência foi, inclusive, proposta pela embaixada norte-americana.

Danilo de Sousa Cavalcante, segundo denúncia, assassinou Válter Júnior Moreira dos Reis no dia 5 de novembro de 2017, por volta de 0h10min, em uma lanchonete localizada na Praça São João Batista, centro de Figueirópolis. Ainda conforme a denúncia, o acusado, efetuou seis disparos de arma de fogo em direção à vítima, tirando-lhe a vida.
Danilo fugiu do local, após cometer o crime, que teria sido motivado por uma suposta dívida que a vítima tinha com ele, referente ao conserto de um veículo.
Após a ocorrência, o acusado fugiu para os Estados Unidos. Em abril de 2021, ele matou a facadas a ex-namorada, Débora Evangelista Brandão, 34 anos, na frente dos filhos, na cidade de Phoenixville. Por esse crime, Danilo foi condenado e atualmente cumpre pena de prisão perpétua na unidade prisional de Chesco, de onde fugiu no dia 31 de agosto do ano passado. A fuga do brasileiro movimentou a polícia da Pensilvânia, que só conseguiu capturá-lo 14 dias depois, em 13 de setembro.

From the United States, Danilo Cavalcante, accused of murder in the city of Figueirópolis, gives up his right to be heard by the Court of the State of Tocantins at an investigative hearing
It was just before 11 a.m. (9 a.m. U.S. time) on Thursday (April 18th) when Danilo Sousa Cavalcante appeared on the transmission screen to give his testimony to the Court of the State of Tocantins via videoconference. Serving a life sentence in an American prison, Danilo is accused of murdering Válter Júnior Moreira dos Reis, in 2017, in the city of Figueirópolis, 270 kilometers from Palmas.
Wearing an orange uniform and long hair, the defendant was apparently uncomfortable and, during a private interview with Public Defender Cristiane Japiassu, he expressed he did not want to take part in the pre-trial hearing. He refused to be heard, a right granted to him by the Court of the State of Tocantins.
Judge Jossanner Nery Nogueira Luna, head of the Specialized Court for Combating Violence against Women and Crimes against Life of the District of Gurupi, who was responsible for the trial, postponed the pre-trial hearing, which was due to take place in October of 2023, to wait for the compliance of the rogatory letter (a legal instrument for communication among the courts of different countries). Thus, without the presence of the defendant, the session, which lasted about an hour, was held at the Forum of the District of Gurupi, with the testimony of five prosecution witnesses appointed by the State Prosecution. Two witnesses testified by videoconference and three in person.
“He has to pay for the crime he committed here in the State of Tocantins, because he is in prison in the United States for the crime he committed there,” said Jessica Wemilly Silva Moura, a friend of the victim and one of the witnesses present at the hearing.
Procedural instruction
The procedural instruction has been concluded and the case now goes to the State Prosecution so that it can make its final arguments. Then it will be the turn of the defense and, subsequently, the case will go back to the Judiciary for Judge Jossanner Nery Nogueira Luna, head of the Specialized Court for Combating Violence against Women and Crimes against Life of the District of Gurupi, to decide whether or not the defendant will be brought before a jury.
The hearing was also attended by Public Prosecutor Rafael Pinto Alamy (prosecution) and Public Defender Cristiane Japiassu, who is representing the accused.
International agreement
Unprecedented in the Judiciary of the State of Tocantins, the hearing was held through an International Cooperation Agreement between the Judiciary of the State of Tocantins and the US courts, with the support of the Brazilian Ministry of Justice. The date of the hearing was even proposed by the US embassy.

Danilo de Sousa Cavalcante, according to the complaint, murdered Válter Júnior Moreira dos Reis on November 5th, 2017, at around 0:10 am, in a snack bar located in the São João Batista Square, in the center of the city of Figueirópolis. According to the complaint, the accused fired six shots at the victim, taking his life.
Danilo fled the scene after committing the crime, which was allegedly motivated by a debt the victim owed him for the repair of a vehicle.
After the incident, the accused fled to the United States. In April of 2021, he stabbed his ex-girlfriend, Débora Evangelista Brandão, 34, to death in front of her children in the city of Phoenixville. For this crime, Danilo was convicted and he is currently serving a life sentence in the Chesco prison unit, from where he escaped on August 31st of last year. The escape of the Brazilian triggered the Pennsylvania police, who only managed to capture him 14 days later, on September 13th.
